TTK Class Action Lawsuit

I'm doing research on starting a class action lawsuit against Bungie and Activision for how they sold The Taken King via false advertisement, cut content from players who didn't purchase TTK without warning or word, overcharging oversea players over twice as much as American players by ignoring currency exchange rates, and overpricing a DLC which content was nowhere near worth the price. There are some solid things that TTK will automatically land Activition and Bungie in court, mainly false advertisement and the currency exchange rate. If I can get enough people to back me up here, so I know I can get some supporters for the class action lawsuit, then I will go ahead and file the lawsuit and post it if it's accepted and in the pending stages. I was robbed of what I bought and I want it back for free, because I paid for it. I am also going to add in this class action lawsuit the abuse of Bungie's EULA. To use that to build a set up to lock out customers to repay for content they already paid for is going beyond reasonable use of EULA. Having one model of business written, then using a different business model to generate revenue is illegal. There is nothing Bungie states in it's EULA that this is a subscription based game and people who don't pay every 3 months will be locked out. Big mistake. If successful, this class action lawsuit will be the gaming equivalent of Abercrombie and Fitch being sued by their employees of their policies and terms that were unethical.     As much as I enjoy the game, I totally agree with this post. I'm in. The abuse of us customers is a little on the ridiculous side. Especially with their prices lately.

      • Missing satire tag. If your actually serious then you are a fool. You won't win as its a frivolous lawsuit, and even if by some miracle you did you would find that nearly all of the winnings go to the lawyers involved and not the people filling the suit.

      • You know bungie probably has multiple lawyers right? Like reallyyyy good lawyers. While, I'm assuming you'll probably have a shitty one since you seem to be butthurt you can't buy ttk (which is a way cheaper option btw). Plus our court system can't really do anything about the prices over seas. Not in their jurisdiction. You'd have to go do that overseas. ANYWAY have fun going bankrupt over a $40 game and losing to a big company, I'm just gunna sit here and play ttk.

        • To all the board lawyers responding to this thread. Think before you post your support of Bungie's action on this. Why would I say something like this? Now pay very close attention because this is important: Allowing companies to arbitrarily remove content wenever they release a new expansion or DLC sets a very dangerous precedent for us, as consumers. It takes away our ability to continue to play any game they choose to do this with, as soon as they release new DLC. Today Bungie and Activision do this and remove large amounts of playable content from this one game and get a bunch of cheers for it from people who are too blind to really look at what they are doing. So lets look at tomorrow, when other companies see what has been done here and start emulating it. Now every time a gaming company introduces new DLC, they make it so the base game and all previous DLC we pay for is invalid and in order to play, you have to pay whatever they wish to charge for the new DLC or your existing game disk is now just another coaster in your man cave or gaming area. Now, whatever you want to play will be a pay to play service, instead of a game you can play a while, put away, then come back and revisit down the road like most of us do from time to time. What Bungie and Activision have done here isn't just the unethical removal of content from one game, its an attempt to set a very bad precedent for the future of gaming. Today, its one game but although these complaints on this forum are revolving around the current title, there is a lot more at stake allowing this kind of behavior to stand than you may reaize. Personally, I like being abe to go back and play games I've had for a while without having to pay for whatever bs dlc has come out since I purchased the game. i also really enjoy seeing all content I paid to play, still available when I put in my game disk. Wake up board lawyers. Your arguing against this case is only hurting you and the rest of the gaming community. You supporting companies that behave in this manner is only going to make all of our gaming ventures cost us a lot more money in the near future.

          • I preordered so I obviously didn't experience the content loss, but I do understand the gripe. I would be furious if I hadn't been able to afford the TTK and logged on to find my game had been gutted. Others can say all they want about the license agreement, but when you pay for a game that game should be able to stand alone as is without purchasing further content. No company is granted immunity from repercussions when they use deceitful business practices, regardless of any EULA or any other contract. I wasn't aware that they had changed the EULA just days before the TTK release. I also wasn't aware that customers overseas were being charged more for the same content. This is clearly shady business. I enjoy the game very much, but I also believe all companies should be held to certain standards when it comes to the treatment of their customers. I think you have a shot at shaking some trees with this.

              A class action lawsuit is definitely plausible. Will it hold up? Well that depends on how aggressive Activision lawyers are. I don't know if any of you are familiar with the OtherOS class action lawsuit that was brought upon Sony in the early days of the PS3, but it was similar in nature. Sony released a firmware update that removed Linux functionality of the console, which was a huge selling point and also a way to market the console as a PC. If you did not agree to their license agreement and update, then you lost all PSN functionality; if you did, you lost the beloved OtherOS functionality. Ultimately, this was dismissed due to not enough proof being presented that made Sony liable. However, Sony had a EULA, just like damn near every other form of digital media. Courts do not say, "well, this EULA states blah blah blah"; case dismissed. What Bungie/Activision has done is wrong, we know it... they know it. Is it worth a lawsuit in the end? Probably not. Other than it being on public record, all they would be ordered to do is issue full refunds to anyone requesting one.... which you can get already. I personally wouldn't waste time on it. If you want to make these tactics publicly known, media outlets are a much more viable approach. With that said, and similarly to the Sony fiasco, this is not good faith and fair dealing on Bungie's behalf, and is a very deceptive business practice since nobody was made aware of this prior to the purchase of the game, or any DLCs. Sure, the EULA stated they could alter the content as they see fit, but what game in history has removed more content (especially previous DLCs) than they added, and essentially locked a large number of the player base out of the core content the game was sold with originally? This is borderline extortion on Bungie/Activision's behalf. Bungie forces players to purchase future content in fear of not doing so will lock them out of previously purchased content. Using intimidation and coercion as means to shovel your product down as many consumer's throats as possible is very shady. They knew what they were doing from the very beginning, and they knew that it would be unexpected by a large number of consumers.

              • I have been doing some thinking but i keep coming to the same conclusion. You arent locked out of any content.... ACTIVITIES yes but not the actual game content of the previous expansions and base game aside from legendary gear and usable weapons. The patrol events were just a temporary thing, keys are still obtained VIA the chests at the end of the POE, you still have access to every mission regardless of difficulties, vanguard strikes are still there, crucible is still there... Still get access to the year one exotics via a Xur exotic engram, the 2 raids... PoE chest if youre lucky.... I will say though i find the fact so many activities locked out is pants-on-head retarded.... I understand they wanna give people a push to buy TTK as thats what any business does but to flat out cut so many activities... just not the greatest way to go about things... I do hold true to the belief that a lawsuit wouldnt hold footing in court without some solid evidence that the game has been rendered unplayable besides personal experience. Just my thoughts on this.

                For every problem there is a solution and before any class action is taken, Bungie still has a chance to address. I too feel the same and tried to get support for the UK for the reasons; UK payed around 33% more and as stated the infringement with UK unable to purchase TTK alone and proved to purchase 2 DLC we already payed for, they have manipulated us into purchasing with no singular option for TTK alone, ta daaaa I'm certain if Bungie doesn't address this they're doomed.(manipulation) I can only think that if Bungie has no response as yet; at the moment there is not enough people expressing their upset, they do not care or their legal team is hammering away before the response! Or maybe all the above....

                • Xanatos, thank you for your efforts. I bought and like TTK. At the same time I believe that Bungie/Activision have made a number of business decisions that break their prior agreements (some explicit, some implicit) with their customers. Such business practices should not be supported, and it seems that the only way to secure this vendors attention is a loud collective voice, bad press, legal action, or all of the above.
