I'm doing research on starting a class action lawsuit against Bungie and Activision for how they sold The Taken King via false advertisement, cut content from players who didn't purchase TTK without warning or word, overcharging oversea players over twice as much as American players by ignoring currency exchange rates, and overpricing a DLC which content was nowhere near worth the price. There are some solid things that TTK will automatically land Activition and Bungie in court, mainly false advertisement and the currency exchange rate. If I can get enough people to back me up here, so I know I can get some supporters for the class action lawsuit, then I will go ahead and file the lawsuit and post it if it's accepted and in the pending stages. I was robbed of what I bought and I want it back for free, because I paid for it.
I am also going to add in this class action lawsuit the abuse of Bungie's EULA. To use that to build a set up to lock out customers to repay for content they already paid for is going beyond reasonable use of EULA. Having one model of business written, then using a different business model to generate revenue is illegal. There is nothing Bungie states in it's EULA that this is a subscription based game and people who don't pay every 3 months will be locked out. Big mistake. If successful, this class action lawsuit will be the gaming equivalent of Abercrombie and Fitch being sued by their employees of their policies and terms that were unethical.
Check out my other forum and share this shit!!!!!

Kid, you just need to breathe deeply and relax. With all the crap in the world - your anger over a video game seems a bit perverse. Pick another game and play it instead. Pick another windmill to tilt at.

And as for the lawsuit, it'll never reach court. First off, where's the evidence of said charges? And the judge will never agree with you because it's your choice to play or not, and to buy it or not. A judge would simply say what a parent or older sibling would say: go play something else. Destiny isn't your life. You don't eat sleep and breathe destiny everyday. If you do, that's your problem, not theirs. It's as simple as turning off your system and taking your ass outside, or popping in a different game that bungie didn't make. Don't be a shit stain. Their lawyers and the people who back both companies certainly outweigh the -blam!-ers who complain about the shit they buy. Don't shoot the man and complain about the jail time, you look like a moron doing so.
-
And then when bungie no longer puts out any games because all of the negative feedback, are you gonna complain because there is no longer anything for you to do in destiny or halo or anything, and say you wasted your money? Don't bite the hand that feeds, it might stop feeding you

Did you know that the launch version of the Limited edition was 100$ for the game first 2 dlcs and a fancy case and book thing that " reveals secrets about the story" had about 1/2 the stuff of the special TTK collectors edition which is 80$? In other words, I paid 20$ more for half the stuff.

22 OdpowiedziI think I have questions and like things to change between people that don't won't dlc and people that buy them. Why do bungie separate us from to different type of people, will to buy or get DLC and people that don't have the money to buy it/ or they don't won't to cause they think it isn't worth buying it.!? There must be a balanced at we can all play together with and with out DLC?! There should be things we can do and share and use the some things like armor weapons leveling up. Yes I understand when you buy dlc you get this and that from the people that doesn't buy them but it should be fair that people that doesn't they should give them something to do adding more stuff to do add thing we could never do and like the third ability like all guardians has how void bow the solar hammer and ark walker it should be for both party dlc people and and non dlc people like I said a great balance that both parties can be happy with each other and happy with you bungie and the destiny game you made. Trust me I played hella lot of your game just it got old and I burn out cause there is nothing to do same shit over and over. You mite or other people reading this think I'm BSing here and going rant on me bout this but think bout this image what is your favorite movie then if you have a partner or best friend or gf or bf ect what are your guys favorite movie. Think bout one then. Tell me when you first watch it wow cool great me ok watch that movie again a week a month a year,? Dose it feel a bit old are starting to feel worn out its not wow or amazing any more playing that same movie over and over 24/7 kind like destiny oh but way a remastered movie of the some one you just the remastered it's like a DLC but it has this and that watch for an other year or to wait there's more a remake an other DLC or remastered remake DLC do you get that I'm going with this hope you do I'm not saying that destiny sucks or its shit or anything things like its good game or a great game but it could of been better it could of been amazing game but it's not sadly if I could fix it or change it I would it a heart beat to make it an amazing game that people won't stop I know how it is now kids won't stop but adult most left hardcore games left there some I'm a hardcore but how it's looking Na wast of my time I got 2 DLC then I didn't buy it and I see 2 different point of view on dlc people and non dlc people so fair I don't like what I see or hear but there things that are good you guys know that is but I need show you that bad and the ugly side

7 OdpowiedziThe single greatest part of your "idea" is that you want to sue for "overpricing a DLC which content was nowhere near worth the price." Of all the things you suggest, this is the worst. It is a completely subjective component of your "lawsuit" that can in no way be proven. Price is dictated by the free market. People had the opportunity to suggest TKK was overpriced by not buying it. Guess what? That is clearly not the case given the sales of TKK. You may BELIEVE the the DLC (really it is an expansion; there is a difference) is not worth the $40 (or whatever price you paid given your location), however the free market has dictated that it was appropriately priced. Had no one bought TKK, Bungie would have been forced to reduce the price. You also contend that Bungie sold TKK via "false advertisement." I'm not saying you are wrong here, I am just unaware of any false advertising. I would be glad to know what was falsely advertised. As far as cut content without warning or word, what do you mean? Do you mean those who did not buy TKK cannot continue playing the game? I don't knwo anyone who has Destiny who didn't buy TKK so I will take you at your word, but it was my understanding that TKK was necessary to continue the game. I am not certain if I heard that from Bungie or I came to that conclusion on my own. Also, Bungie i allowed to set the price of a game in any country for the price they wish (provided that country has no laws requiring a specific type of pricing). Bungie is under no obligation to take currency exchange rates into account unless that country's laws specifically dictate that they do. You also may want to do a little math as none of the exchange rates would dictate a doubling in price if listed at the 40 pound, Canadian Dollar, Yen, etc... price. All of this boils down to you being upset that TKK has resulted in you not being able to play the game without purchasing it. I understand and even sympathize with your frustration, but you seem to have little legal recourse. The only POSSIBLE thing you may have a decent point on is the immediate restriction of use of Destiny by players who didn't purchase TKK. Again, I deduced that TKK was necessary to continue Destiny but am unsure if Bungie explicitly said that with a fair amount of time to warn players or if I came to that conclusion on my own.

Bump, they need someone to stand up to them. These big corporations think that with all their fancy licensing agreements no one wants to read at the beginning and all their lawyers, that no one will ever be able to sue them. They think they can steal our money in these huge build ups and failures over and over, all while believing they're untouchable behind their wall of lawyers, and small print you are forced to accept before you can accurately determine wether or not it's good. I say to hell with them and screw this game for taking my money. Anyone who thinks their mlg for touching this shit is a -blam!-ing circus clown and I'll just spit in your face irl if you try to tell me it takes skill to play its pvp or pve. Try counter strike global offensive some time.
-
I only paid 50 bucks for the legendary edition and got all the content lol
-
Find me something to sign and I'm down for a class action.
-
So you're going to sue Bungie and Activision and ruin the game for millions of people because you didn't like the Taken King expansion? Bummer
-
Be honest. You have a bad case of buyers remorse. I for one have 1500 hours playtime. Payed €140 for the bare minimum and it is a shame now that the game is going in the right direction. Bungie/Activision money grabbing policies are taking a worrying direction. Many of you won't care and just sign the agreement without any thought. But what their saying is at any moment they can change the agreement or update anything. Charge you for an update/ licence to be able to play the game you bought with all content included. So this is "becoming legend". Not worth a law suit. Cut your losses and move on.
