This would go against the 14th Amendment of the Constitution:

While only States are mentioned, the 5th Amendment does apply with the 14th, with the due process clause. Along with the equal protection clause of the 14th being incorporated with the 5th, they are intertwined.

13 RespuestasI disagree with Trump’s course of action on this. The Supreme Court should decide whether or not children born in the US from non-citizens should receive citizenship. I for one don’t think they should but that is my take.
