The US can't say what games can and can't be produced because they're an art form and are protected by the first amendment.
But the last time the government stepped in to regulate video games the ESRB was created to self regulate video game and their ratings. The easiest way to solve this problem is to force the ESRB to do their jobs and make all games with loot boxes rated A for adults only since they have gambling in them.
And I don't care if you say loot boxes aren't legally gambling. They're colloquially gambling and the law hasn't caught up yet.
So its rated A for adults. Nothing changes. Biggest mtx purchaser are over 21. It will be a short lived victory when you realize the government didn’t fix anything.

Don't know about Microsoft, but either way that eliminates the majority of potential buyers.

Right now they don't. You think the gaming industry just rolls over? They could add another rating possibly coudn't they? Stores could have a change of heart pretty fast as well knowing that it is A because of lootboxes only. The idea that a law will be passed and that will end lootboxes is laughable. We are talking 10's of billions of dollars at stake across all gaming platforms including mobile. I mean I support a way to limit them but anyone can see they will not be eliminated. That is a losing battle.

Actually for games like overwatch and destiny it would be a huge deal and mean a huge change. Even if the majority of purchasers of games are over 21, that doesnt mean it is the majority of players. Who exactly do you think buys games for the 13 year olds? Because they certainly arent buying them themselves. And if the age rating changes, they will be seeing a huge drop in sales. That A/M rating would cause them to change their loot box system immediately. Not onlt would no one under 21 be allowed to purchase the game themselves, but also many adults would no longer buy the game for their kids. A/M rated games of course still make money, but T and E rated games tend to make a lot more. It is the same thing with movies. Why do you think the vast majority of super hero movies dont have nearly as much violence, death, and dark storylines as in their comics? Because if they had that, then they would be R rated. And while movies like dead poll can still make a good chunk of money while being R rated, it is nothing in comparison to the non R rated movies.

So a M rated game right now isn’t played by a TON of kids? LOL they are filled with them and parents buy them these games. You think lootboxes is where parent draw the line? Here jimmy play GTA but not destiny cuz it has lootboxes. Seriously think about it. Average age of a gamer is in his mid 30’s. Go do some homework on the subject before throwing out silly arguements.

You still dont get it. It has nothing to do with the average age of the average gamer, it also has nothing to do with the number of parents that buy their kids games that are M rated. It is about the fact that they would end up losing at least a noticeable amount of money that they could easily be making by just tweaking their loot box system. Do tour homework on the basics of business next time. If doing one small change that costs you next to nothing gains you even a 5% larger player base, they will make that change. If their game was suddenly rated M they would lose at least some of their current player base, but by changing their system and keeping their T rating they would lose no one. It is pretty simple to figure out. I cant see a group of people leaving destint because now when they pay real money they get to choose which item they would like to have.
-
Losing a % of revenue woud be an acceptable loss if lootboxes and mtx could remain. They wont tweak lootboxes and mtx enough to lose more revenue to keep it T rated. They would take the M or A rating and make more money that way.
-
That percentage ends up equalling far more than you think. They also would only be changing loot boxes that you pay for, the loot boxes that you earn in game would remain since you dont spend any money on them and so they cant be considered gambling. Literally the only thing they would have to change is the real money versions, in which case they would just increase the price saying that it is now higher since you are guaranteed to get what you want. They would lose little to no money from the change, in fact they may gain money since those who were not willing to pay for only a chance at stuff, may now begin paying because it is a sure thing. There is a reason that games like halo 5, and such made changes and tried fairly hard to ensure they would have a T rating. They found that having a T rating vs an M rating made them a fair amount more money. Again it is the same as movies. Movies fight very hard in many cases to ensure they do not end up with things like M ratings. They will even make changes after the film is done and put together if it comes back as a rating they did not want. Video games do the same things.
-
Maybe it just depends on how they sell them. I see what your saying but it only works if they decide to sell you what you want. In the end they still make billions for minimal effort.

Ya i get that. I personally would just like to see it go through just to rattle the ages of these developers. I would like to see what they do in reaction. I also hope that it would smarten then up a bit and show them that they dont just get a free pass, the government and citizens will poke their noses in if you miss behave. Sometimes good things happen when cages are rattle. Like when the organizations for rating games and movies were created.
