10 RespuestasIf you actually paid attention to what happened, the court only stated that they would continue the ban while the court determines if it is constitutional or not. They didn't rule it as anything yet. Just that since the president issued it, we should uphold it until it is found to be unconstitutional (which it will be).

The Supreme Court just put a stay on the preliminary injunction filed against the travel ban. This does not make any statement on the legality or constitutionality of the ban, but it does let it go into effect while the lower courts continue to work on it, and the ban will probably make it's way to the Supreme Court eventually anyways. It [i]is[/i] possible that the Supreme Court thinks there's a reasonable chance that the travel ban will be found to be legal however, as "a reasonable likelihood of success on the merits" is [url=https://law.freeadvice.com/litigation/legal_remedies/refuse-injunction-relief.htm]one of the elements[/url] that might factor into obtaining injunctive relief, but the white house had been heavily pressing the "irreparable harm" element too, which may have actually been the reason for the stay. So while this might be suggestive of a future win for the Trump admin, we really can't say for sure because the Supreme Court didn't actually say anything of note in [url=https://www.supremecourt.gov/orders/courtorders/120417zr1_j4ek.pdf]the orders[/url].
