Malfeasance is not accessible to free-to-play guardians.
Since patch 2.8.0, the Seething Heart is able to be dropped to players without the Forsaken DLC by killing the ascendant primeval servitor and winning that gambit round. However, what I have experienced myself is that, after killing the servitor and winning the same round for countless times, I still don't see any Seething Heart be dropped. Besides, when I go to the Drifter, there is an exotic quest named "Malfeasance" which requires the Forsaken DLC.
It seems to be a bug to me. If not, please clarify the requirements or explanation in the patch note.
