Actually there are was to legally subvert EULAs...especially in class action suits. Not that I'm advocating it, its absurd but still...its happened to Apple, Microsoft, Sony, and even Nintendo. Oh and Google. Consumer rights largely can't be signed away. If and individual wanted to sue...you are correct. No rights essentially. A class action lawsuit however...totally doable.
