Kinect has to be plugged in for the console to function unfortunately. Even though most, if not everyone, who buys the console will not bother using it.

If you don't want to risk being monitored, then you shouldn't use the Xbox One. That is the price of your paranoia. Look at it this way, are Digital Cameras in the UK / EU any different from Digital Cameras in other parts of the world as a result of this law? Probably not, there's sorta this implicit common sense that if you're going to use a camera, it's going to gather and use information from your surroundings, and that information might potentially be used by Aliens or Mustache Twirling Evil Scientists. You have your option to turn it off, but don't have the option to both use the device and turn the camera off. That's just selfish and stupid.

I personally don't particular care about them getting a hold of any recordings of me, when i play i'm merely sitting down focusing. However digital cameras are not that suitable as an example because of the primary purpose of a camera, which is to take photos, whereas a camera phone has the option to turn off the camera if you want. And they cannot collect information that may be considered private without your explicit permission, and it has to follow 6 other things before it is allowed to collect private data on you.
