Xbox one is illegal under EU law

[Image shows the advantage us europeans have in steam] Some of these features of the xbox one appear to be quite illegal if they were to occur in the EU/UK. With the features of an always on kinect, collecting data on us possibility and the issue of not actually having rights to games anymore. The first issue being is that under EU law all webcams must have an option to be turned off and cannot be made mandatory, the xbox one violates data protection laws. Federal data protection act Another issue is the the debacle with used games. As ruled by the EU court EULA's are overrule by the right to sell any digitally bought sales. Article on it These are just the current issues that can be seen with the xbone. If these DRM follows through what will happen to the selling in europe? I mean cutting out a large chunk of your target market doesn't bode well in business. TLDR: The drm features break eu law on used game sales and on privacy. In response to everyone saying can be turned off, it was stated it could be "paused" whilst in use. link
Instead, the Kinect controller, when not in use, is only ever waiting to hear the "Xbox On" command to activate the console, and is otherwise idling. Microsoft also revealed that you can "pause" the motion sensor, controlling the console through traditional means like a gamepad or remote control when gestures and voice commands are switched off.
"Pause" implies it is still partially active otherwise they would of said it can be "turned off". Over here webcams must have the option to be fully turned off if we want to, pausing does not count.

  • Sony would be wise to launch PS4 in Europe first, doing a robbery like pulling someone's bird geordie style.

  • Lol that order of events in that picture is pretty hilarious. >You will give me a refund because this game sucks compared to the others and UK law demands it >Sorry but our personal contract that you agreed to on Steam prevents us from giving a refund >Well how about you take a look at this regulation right here *insert 2000 regulation* and give me a refund, and if you can't, forward the ticket to your manager >Okay herp here's your refund lol

    • So is steam. They faced a class action lawsuit and still haven't changed anything.

      • I will inevitably upgrade at some point from the 360, when I do however, I intend to cover the sensor or put a picture in front of it. I'll also unplug it when I'm done playing

      • While kinect has to be plugged it, it doesn't have to be on.

        • Kinect Camera < Any item thicker than tracing paper. Microphone....I'd have to weigh this one up but if I KNEW it was always on and if I had alternate comms then I'd just open the case and crush it with a pair of pliers.

          • Wow lol, try harder next time kid. The Kinect sensor can be turned off at any time, it is not mandatory. The Xbox One simply comes packaged with it so you do not have to go out and buy one yourself. If you do not want it, then you are not forced to use it. And I do not understand the problem with used games that everyone has. If you want a game, go buy it, instead of trading your games with all of your friends and stealing money from the game developers.

            • It's already been confirmed that you can turn the new Kinect COMPLETELY off. Microsoft spoke out on that one. Not sure about the DRM sales though. Could cause quite the mess...
