By law it must be able to turn completely off. Also the microsoft store thing where you can only sell in certain stores counts as trying to oppose sales as we would be unable to sell privately.

Functionally, what's different between an off Kinect and a paused Kinect? I'm guessing the important bit is that it can't take or transmit video, which would be the case when paused.

That's what i've been wondering, if you could actually turn it off completely why didn't they just say that instead of saying it can be paused. Paused implies some functions are stopped but the system is still waiting for a command.

Then that shouldn't be allowed, webcams over here have to have the option of being completely turned off for use. A kinect capable of detecting your heart beat and moods is most likely not going to be accepted.

Right, webcams. The kinect has a webcam that can be off (or paused) while the microphone, which is not a webcam, waits for a command.
