Correct because the tenth amendment is a thing that exists.

But if it's unconstitutional for the states to ban the thing, then the supreme court can overrule the state at the federal level. Probably not the best wording, sorry. My understanding of the constitution may not be the best, but I'm pretty sure federal>state

Federal>state for things that federal have a say in but conflict with the state. The 10 amendment says that the federal government only has control over things given to them in the constitution. So for things not given to them in the constitution (they should) have no say, giving the state 100% jurisdiction.

Pretty sure there's something in the constitution about equal rights for all, it's just only recently that people have conscious enough to bring up the fact that same sex couples were getting second class treatment.
