agreed with you 100%. an other consideration we can do is the different situation in which we mod a licensed product (like Destiny 2) or we add/change functionalities to our OS (installing applications or even dropping 'verified/secure/trusty' dlls in it). Bungies and BattleEyes have no legal base to ban or threaten to ban anyone from installing external content in his/her computer when it doesn't modify Destiny 2 files, Destiny 2 behavior or Destiny 2 player experience (this include all cheats effects). Bungie doesn't own our machine or our configuration of it, maybe they forgot that. But can be remembered in courts.
