TL,DR: I was banned for "reasons", got my full refund from gamesplanet's amazing support, here's my story, brace for very long post and excuse me if there are mistakes (English is not my first language).
On the fourth of November I was account banned from the game, without having cheated, without any explaination given. I immidiately reached out to the forum to get an explaination, only to find silence and hostility from other members.
I then started my process through Gamesplanet's support after Bungie, Activision and Blizzard failed me and I was amazed by their understanding and patience. here are some of the 20 emails we exchanged to get to the refund.

Reading the support pages of Bungie, they say that whenever a player will be banned, a message would display further information on how the ban has been applied (Device vs. Account ban).

To be clear on the legal position for this, purchasing a game is not "legally owning it", you purchased a license / the right to play under certain circumstances (here very specifically: not cheating). Don't get us wrong on this, we don't judge you, it's your PC and you can do with it whatever you want, but it should come to no surprise that Bungie applies a ban on your account if you're found to own/use software that actually interfers with the usage of Destiny 2.

The EULA/Terms Of Service of destiny states, about account bans:
[b]Using an external program to modify [/b]the operation of the Destiny game software, such as:
Trainers, mods, cheats, aimbots, or autofire.
User mode or kernel debuggers
Graphics hacks
Sending malicious network traffic to Destiny servers or other Destiny players

I didn’t use a program to modify Destiny, so I was quite sure that a mistake occurred in the review of an anomalous report, until a Bungie employee “Cozmo” replied to one of the many post on the forum (all about the same problem, many people actually had their account banned) you can find his post here: https://www.bungie.net/en/Forums/Post/237891797?sort=0&page=0&path=1, he states:
We do not ban players for simply having cheat tools installed, but do ban for running them while playing Destiny 2.
[b]We do not differentiate between cheat tools for Destiny 2 and cheat tools for other games because it would be easy to avoid a ban by making a Destiny 2 cheat tool that pretends to be a cheat tool for another game.[/b]
Make sure you turn all cheat tools off before running Destiny 2 and you won’t have to worry about bans.
No one is being banned for third-party applications that try to inject overlays like Discord, XSplit, OBS, RTSS, Shadowplay, etc.
As you can clearly see from this post they are banning people simply for owning or forgetting in background programs that they consider cheeting software, which can very well be programming tools used for work (kernel debuggers / user mode).
This contraddicts the EULA/TOS which only forbids to use them (I also replied to Cozmo, without any response from him: https://www.bungie.net/en/Forums/Post/238004104?sort=0&page=0&path=1).
As I said before, owning a software that can modify the game is not using it, they banned without providing proof and violating their own EULA/TOS, I’m very sorry that I cannot give any concrete evidence that I didn’t cheat, it would be impossible on my end and I understand the position that you are in, if Bungie would provide data about my ban you would see that I wasn’t modifying the game.
This is the reason why I’m requesting a refund, I was banned because of something that wasn’t specified on the EULA, without warning.

23 RepliesConsidering the outcome: Good for you on getting the refund, but I'm also a technology person with experience towards that: I've been explaining this in a few posts all of which have been "unpopular" by the forums standards, so I expect this to get your same response: You were in fact cheating. Gamesplanet should not have refunded your amount owed. Again, good that you got your overall reward, but you clearly should review the OSI model anout networking because you clearly don't know that process management means a process is actively transitioning data to Bungie servers which allows them to know what is running in the first place. Good on you for being a technology student, but honestly? Gamesplanet made a rash decision based on a tier 1 support opinion and not OSI model technology facts. All the same? It's a video game. I don't think any gamer actually agrees with a video game in 2017 being restricted from a refund so long as you don't play all the content. That's honestly how it should be, so no fault on you for seeking the refund.

Bungie don't appear to care whether you're cheating or not. if you have a tool running that would potentially allow you to cheat then you're apparently presumed to be guilty. Whether that's a good or bad thing I'll leave to individual interpretation.

Glad you got your refund. Your email exchange was an interesting read. Just one of many stories about BungieVisions 'wall' between players and support. I would say you got lucky.

Non of them act like Bungie's non of them ban cheatengine without injection to the process its protecting. Non of them are nonsense because they believe in good customer experience first.

I'm not sure why they thought second-hand players ought to be banned but to my understanding a massive ban went out for the reason of cheating: They took it that if any player played with a cheater for an extended time, they too would be accused of cheating. Whether they were in the fireteam while the cheater was exploiting whatever or not. Say Player A uses DDOS or whatever to gain a illegitamate advantage. If Player B is often in Player A's fireteam, they too will be banned...whether they are present for the cheating or not. Regardless, hopefully you come back around to play...if not, glad you were able to get your refund back!

Only wish I hadn't bought the game through Blizzard. Although, I am only restricted I fully expect to get banned shortly after becoming unrestricted only due in part because I'm going to continue playing the game as I did beforehand. Did nothing wrong. Just got on Tuesday and was restricted for seemingly no reason. Oh well. Lesson learned. Just glad I didn't purchase the deluxe edition. This will certainly be my last bungie game. Most of my friends quit playing already anyway.

I'm glad you were able to get help. But, this is what many of us have tried to communicate with you seeking refunds: you must communicate with the retailer whom you purchased the game from. In this case, it was gamesplanet. Bungie [u]does not[/u] issue refunds. Thank you for sharing this.

I won't be glad getting a refund since i really wanted to play this game with my friends ( and btw i have on of them unbanned recently so they keep lying to us more and more )....
