A few years ago, I had some people at my house. One of the guys ended up stealing $3,000 in cash out of my bedroom, and one of my security cameras caught him in the act.
Long story short, the judge handling the Small Claims case voted in my favor today, and awarded me $6,750 - including damages, interest, and other court-related fees.
According to the Statement of Assets, the other party listed the following items currently in his name that is able to pay off the judgment. What should I choose?

Jeep because unless you like photography or DJ equipment there useless to you and people really don't see motorcycles that don't sound like a combustion engine on crack my parents had motorcycles and they were almost ran over multiple times while commuting

I guess it depends on what you feel is reasonable to make the debt 'even'. Imo, if you take the Jeep, are you taking away his ability to travel for work? That would inflict the most damage to him economically. The equipment, neither are of any equitable real world value, unless you find the right buyer for it or really have any interest in them yourself. That leaves the cycle. It is the closest of value to the judgement. It's worth more than he took from you. It would be resell-able. It could easy be that you are saving his life, for those things are rolling death traps.

4 RepliesSo the court awarded you damages in a particular dollar amount, the defendant has a list of assets and the court essentially told you that it's a sort of "shopping list" where you pick and choose until the balance is settled? That seems a little odd to me. Not unreasonable, just unusual. I would have thought that the court would order the defendant to liquidate their assets in order to pay the ordered amount, or if the defendant either refused or couldn't decide, that the judge would then pick and choose the objects/items to either award to you, or order them sold with the proceeds going to you until the balance was met. I've never paid too close of attention to the details of small claims suits and how judgements or awards are settled so I didn't realize that they are handled that way. I would imagine that depending on the plaintiff and the defendants assets, if the plaintiff wanted to not only recoup their losses but to also wanted to shaft the defendant, they could chose items that would inflict damage, cause emotional distress or impact the livelihood of the defendant.
