1) Yes, the 360 would need to be turned on in order for it to work. The 360 is the one actually playing the game, having it plugged into the back of the One just makes it so that you don;'t have to switch the cords that are plugged into the back of the tv.
2) When playing a 360 game, you must use the 360 controller. The 360 won't recognize the One controller.

Thanks! 1) But if I'm playing, let's say, Halo 3 on my 360. Can I still play in party chat on the Xbox One? Or to go even further, if I'm playing an original Xbox game (San Andreas, Combat Evolved. Something that wouldn't let me talk in party chat on the 360) can I still talk in party chat on my One? 2) Yeah, that makes sense. Kind of pissed off, though. I love the One controller.

I don't know the answer to #1, as I haven't even unpacked my Xbone headset in the last three months, but it is an interesting question I'd also love an answer for.
