I'm not sure about America, but here in Britain we have laws prohibiting private institutions and organisations from discriminating individuals based on sex, religion, ethnicity, disability and you guessed it, sexual orientation.
I'm not really quite getting this "it's a private institution, they can do what they like" sentiment the Flood is espousing today. Surely it makes sense to implement regulations preventing collective organisations (since they affect a lot more people on a wider scale, as opposed to singular individuals) from doing such a thing.
Then again, I know talking about big scary government intervention is like nails on a chalkboard to the edgy teens of the Flood. So I'm not expecting this post to go down well.

It's also part of the policy in the school. Zmuda stated that the policy was not to discriminate someone based on those factors as well, but I guess this is an exception.

Can this not be taken to court then?
-
He can, but in the video, he stated that he's just going to search for another job elsewhere with the same duties, or even the superintendent. The reason why it's not a legal issue, like everyone in this thread has been pointing out, is because he's probably not going to take it to court and he's just going to find another way around it and continue to live life. He likes the people in the school, so he's probably not going to want to hurt them with something like this in court.

If he hasn't yet, then I assume he doesn't want to do that. He probably just wants his job back, he doesn't want to hurt the school and his friends.
