To be fair, kryptonite is like the quintessential example of a 'deus ex machina' plot device. It's like the Konami Code of comics.

At least it's well known that Batman always has kryptonite on him, as with Lex, so it isn't too much of a deus ex machina, more so a way for the "lesser villains" to keep up. Though it's obvious it only really works when the writers want it to, given the fact that in theory, metallo should have killed Superman 10 times over.
