Special K fps limiter, can you get banned for it?

Basically as title says, I know Rivatuner doesn't work, nor do I try to make it work on D2. But Im trying out Special K running in the background as a general fps limiter and dont know if I could possibly get flagged by battle eye.

Special K's global injection uses SetWindowsHookEx. If I wanted to get cheats in going into hook chains is an idea. All anti-cheats do some validation of these. But then again battleye wont flag windivert for that [i]other[/i] type of limiting so who knows. I would say stay away from tools like that.
