If a person gives consent while drunk

It should be legal consent. You are responsible for your actions. If you get behind the wheel of a car, you are responsible for any damage caused. Likewise with consent. If you can say yes, you should be held just as responsible for the fallout of that choice as any damage caused by drunk driving.

    • Don't you know that a legally intoxicated female can't consent to any sexual acts. Every man is expected to have a properly calibrated breathalyzer with him at all times. This test must be administered before any sexual contact is initiated. Failure to comply will result in arrest, prosecution, and conviction of any and all male violators.

        • It's definitely a complicated gray area, I don't really understand why the guy is blamed 99.9% of the time. All a woman does is say it was r@pe and they're instantly of the hook, that's just sad.

          • The interesting little thing with drinking is, a lot of people, after being drunk, when talked to about something they may have said, often like to say, "Oh, I was just drunk." The interesting thing is, while yes, they were drunk, it's not neccessarily an excuse. When you're drunk, or especially pissed drunk, you've no inhibitions. That's why drunk people often do stupid things. That's why some people, when drunk, have different personalities. You'll often hear things like, "Oh they're a totally different person when they're drunk." That's because there's absolutely no inhibitions holding them back. Anything you'd normally be reserved about, anything you keep pent up inside, and all the little stray random thoughts that go through people's heads, is all free to come out. If anything, when you're drunk, you're probably the most honest and sincere you'll ever be. Besides losing cognitive reaction times and function the more your fill yourself up.

            • If you're drunk and drive your car you're held responsible. You can't be held liable for any legal or binding agreement made while intoxicated however. I'm not sure what your concern is toward?

            • This is where I find things muddy. Personally I feel that if consent occurs when both parties are drunk then that their should be considered appropriate. However if one party is sober and the other is drunk than I feel that the sober party should be held in contempt/be prepared to face the law. [spoiler]i say this as a guy who was on the receiving end of being a victim. And yes women can take advantage of man as well[/spoiler]

            • I agree. It is part of being an adult. If adults cannot handle that responsibility, then they should not be drinking in the first place. However, I would point out that being passed-out drunk and/or given alcohol unaware is -blam!-, since foul play was involved.

              If you get yourself wasted and you end up doing something you regret I feel that your at fault for your actions, and as much contradictions will follow, I still don't think your consent should have legal merit if your impaired in some way, wasted or otherwise.

Because you are not in full control of your actions. I believe the same reasoning applies here too - Giving consent while you may not be fully aware of your actions may not hold validity of that said consent.                 • Shouldn't the other party know that their partner is "under the influence" and take actions that do not put them in a compromising position? Example: Don't have sex with the drunk person?
