Bungie is perfectly capable of getting away with it for one simple reason, and its a genuine idea for them.
You are buying the silver, not the loot boxes. So there is no paid gambling, you are buying exactly what you pay for.

The box itself has no cost, its the silver that costs. This has not changed your mind so i won't bother.
