1)Mouse and keyboard is more accurate, plus you have aim assist
2)it's a modification of hardware/software

You do realize everyone has access to a keyboard and mouse do you not?

You do realize everyone has access to modification software, do you not? Having access doesn't make it any more or less of an issue.
