The Taken King was never part of a free up grade [u]for anyone[/u]. It required purchase on all consoles.
You will not be given the Forsaken expansion for free either, if you wish to play Forsaken you will need to purchase it on the console you wish to play it on.
The Forsaken requires Curse of Osiris and Warmind.

I have curse and warmind. What a huge scam and ripoff this is why I stopped playing destiny 1 in the first place. Can't bungie (idk if you work for them) release a completed game without all this price gouging? I literally got a ps4 the next day I got the taken king without the knowledge that it would not transfer over and when I tried to complain I couldn't get ahold of anyone. The other stuff tranfered over like destiny itself but not the dlc? Strange... well I tell you I will not be purchasing the next expantion because of this and I will be filing a complaint formally and with the bbb

You stopped playing because you felt you had been ripped off, yet still consider yourself loyal? As far as 'the other stuff' transferring over. DLC 1 and 2 transferred over because they were released early in the new generation's cycle, and as a show to support their customers, Bungie allowed them to transfer over. The base game, Destiny, also had a time-limited window in which the digital version transferred over (for the same reason). TTK came out a year later, and as such, everyone had had plenty of time to get a new console if they wanted one and could afford it, so it was no longer necessary to offer it as a freebie upgrade, so Bungie didn't. It'd be cheaper for you in the long run anyway if you simply purchased Destiny: The Collection, as purchasing TTK and Rise of Iron will cost you more than simply purchasing the bundle or Rise of Iron at this point; plenty of places have it on sale, and it comes with TTK.

FYI, the Better Business Bureau is not a regulatory agency, or a government agency. They have no authority to do anything. So you go right on ahead and file that complaint, and see how quickly it gets you your refund/free dlc.
