Is it possible to sue Bungie for neglecting their servers?

Because I want to. It seems very unethical to me. How is it that they -blam!-ed up so badly? I can hardly play the game half the time. Almost always get caterpillar error codes followed by xbox live disconnect... Edit: there has to be At least a few lawyers on the forums... Or at least studying law. Anyone know? I'd suggest a class-action law suit. It may wake Bungie up. Honestly I'd rather they take the game servers down for like 3 solid days and just fix it than this... If I could I would record a video and post it on here of my destiny experience. I may be able to play for 5 minutes or maybe for an hour. But I WILL disconnect guaranteed. Even my roommate who doesn't play understands. Destiny is a video game. Entertainment. Stress relief. That's why I bought it. Instead it gives me stress. Edit: I do not think of myself as unreasonable. I do not think lawsuits should be thrown around. I think the woman who sued McDonald's for hot coffee should burn (pun intended), and the red Bull law suit is a joke. I think there are legitimate and justified grounds for a lawsuit against Bungie. Edit 2: terms of service do not make a company immune to lawsuit. Even if they write in there they are 100% immune from all legal action regardless of their actions or if they murder your mother, they can still be liable Edit 3: if you have come here to tell me I am an idiot prepare to be countered with logic and reason. Please read the comments before you say something because I will no longer keep saying the same things over and over

  • No you can't sue them for that it's a open server and they can just fire back that it's your Internet connection everything is covered by there terms and agreements..yet have lawyers who put it together for s reason just send in your error codes and put a ticket in

  • Just sue them for giving us this false game. The game before launch was different game altogether had a different aspect to it and seven months later they changed it

    • The disparity between experiences in these forums is likely more to do with ISP choice than Bungie. Packet loss, speed, ping differential can all impact game experience. I personally have Comcast' 105Mps speed tier and have no such issues.

    • Some of it is not bungie fault..Your connection travels through routers numerous companies..The internet!! Things break..they hicup..crap happens..It sux if your in a nightfall or Raid and get booted..Also..your line may be fine..your house wiring may be fine..but your provider may have hicups...Still bungie says report the codes your getting for a reason..keep sending codes in. I been kicked from all kinds of online games since Internet games started..Can you prove they are intentionally booting you...No...so the answer is no u can't sue them. You must really love the game to hate it so much

    • Neglect by definition at its core means to pay no to little attention to. I do believe they acknowledged and took responsibility for the minor problems bungie, as well as you have experienced. I also recall an apology. Even if you think you had grounds to sue, when you look at the entire scope when mathematically calculated the servers are easily in the 89% operational category. Also factor in lizard. This part is for fun. First this case would be in Seattle. You would having e to go to them to sue. Airfare and hotel expenses. Groceries and a rental car. Now you need a lawyer. No lawyer would take this case for free due to having no chance of a ROI. Now you are paying all of these expenses. If I were in that case knowing you were paying for those expenses I would prolong the case to bleed you dry of money. In all reality.. This is not feasible.. Friend :)

        No it is not Various hacker groups have caused serious and malicious activity. A good percentage of your experience with bad connectivity is because of hackers. Yes the servers are not that great, but they are not bad. All conditions being normal, I could tell you flat out you would never have a case. If you managed to get one (never) I can confirm their legal department is scary in the courtroom. Just how I like it Edit: neglect is hear say unless you can prove neglect. Those are serious accusations. I believe DeeJ addressed they are working on things every day to provide updates as fast as possible

        • Well if you read any games terms of service it clearly states that by playing the game you agree to the terms and within the terms is a part saying you cannot sue the company and by playing peroid you agree to that and its leagly binding so nothing you can do

          • If anything, we'd all hafta file fraud claims, which would eventually become a class action lawsuit - and potential settlement. I imagine Activision would initiate a recall before it got to that, though. And honestly, the issues may seem bad on our end, but it's hardly the kinda thing Bungie can't fix... imho.

              I agree, but like they said you will need a good lawyer. Doesn't matter either way, Bungie/Activision has lost tens of thousands of players, I highly doubt anyone will be buying the expansion pack now nor will they be crazy enough to buy Destiny 2, so they are only shooting themselves in the foot.

              • well put. this is a disgrace, Ive been disconnected everyday sence day 2 and on top of the broken game my gamestop dealer jipped me 5$ on the game (gave him 70$ he said I gave him 65 wen I had no 5s or 1s....) not that im all that angry about my gone 5$ but the broken game is unacceptable. 65$ for what? an online beaver?

              • honestly I'm surprised bungie didn't take this down yet. but if they were to be sued I'd say it would be for those unaware sadly like myself that DLC content placed solely on the playstation at the game's price and then turning around and charging Microsoft/xbox users the same price without any content and future content hadn't come up? Personally it pisses me off I got my game as a present from my grandma before she passed away. My abuela was a very kind loving old woman who loved her family very much and to get a gift from her meant something to us, so wtf bungie wtf? you guys are evil to sell a product at full price when it didn't even include everything you all should be ashamed.

              • "Caterpillar followed by Xboxlive disconnect" ... it sounds like your problem is either your internet is unstable or you're having trouble with Xboxlive. I've been kicked out of Destiny before but it didn't kick me out of PS+. If you lose connection to your console server, you are going to lose connection to the game. So if you want to sue someone you'll need to start with Microsoft. That being said, if you read the fine print on any online game, they don't guarantee service. At most you could argue for a refund. Quite frankly the court costs would outweigh the cost of the game. So you are better off just trading it in at a loss than pursuing legal action.

              • The only part about this that doesn't make sense to me is the fact that 99% of the people I've played with don't have any issues. I've personally only been disconnected 4 times, and that was pre-maintenance. My buddy was getting disconnected from destiny 10-12 times in any given night, but he did a full factory reset on his router and it solved his problems. I'm not saying that Bungies servers AREN'T to blame, I'm just saying that it's more likely an ISP or equipment issue.

              • I will say that the Hot Coffee lawsuit was actually a legit thing and was twisted by the media (I watched an expose on a few months back and man did the media twist that story around) really badly. Anyways, I say sue them. I'd join that class-action lawsuit.

                • The lady from Mcdonald was over the age of 60 and had worst then 3rd degree burns because the person passing the coffee from the window to the car didn't secure the lid. She had to have skin graphs. Further the machine was broken and 2 other people had gotten hurt from that machine at the same location. ...I watched the documentary.

                  • Port your modem to their servers. If you cant figure out how to port forward. Then look it up on google. I did it. havent had an issue since.
