A cautionary tale of eBay (New info for old readers!)

I have edited the title based on feedback from some people. It was originally "Watch out for seargentkillerx on eBay". However, I feel that title was to loaded with my bias. I want to be fair so I changed it. Bear in mind, I wrote this immediately after the issue. There will likely be bias, and it is meant to caution against a specific buyer. Pleas keep all this in mind. So this is a story of my experience with sergeantkillerx, who is a member on eBay. And I put this in the Destiny forums because I attempted to buy a Destiny: Ghost Edition from him when things went ary, and almost led to me missing out on this fantastic item. Being as he may put up more copies, or other Destiny related material, I came here to share my very poor experience with him. You should judge this for yourself, and bear in mind that I can only give my side of the story. I have provided sergeantkillerx a link to this thread so that he may dispute me. I mean for this to be a cautionary, but fair explanation of why I think you should avoid this seller. That said, here's the issue: On July 9th I had found a listing for the Destiny Ghost Edition for 300 Canadian Dollars + 15 CD for shipping. FANTASTIC! I was bouncing off the walls in a giddy joy, squealing like I was 13 again. So I accepted the offer and then payed via paypal shortly after. He then messaged me saying thanks and specifying when it would be shipped. I was very happy and thought the deal was done. However, the seller, sergeantkillerx, then found out that eBay policy on pre-orders/pre-sellings was that no listing could be made for a pre-release game until one month in advance of it's release... meaning we couldn't make the deal until August 9th. The seller sent me multiple, very apologetic messages one of which was this one: (All of these quotes are copied exactly from my eBay messages page, I have not altered them in any way)
- sergeantkillerx Hey, Sorry I'm sorry eBay just messages me saying I have to cancel all my translations or they will suspend my account and do it. I will have another ad up for you on August 9 and I'll message you the name of ad so you can get again. Again I'm truly sorry and will message you please leave positive feed back and I will do the same but I promise I will email you a day time I put back up again ok?
It was a simple mistake, and I didn't know either so it was at least partially my mistake as well. He immediately refunded my money. So I responded:
- zach-hhzhtjqc9 Shouldn't be a problem, I can't access the case right now for some reason, so if it needs my response to cancel quicker it will have to wait. I will respond to the eBay case as soon as I can. And I meant to leave some positive feedback but eBay won't let me for another day or so... new account and all. I loo forward to that e-mail.
Then, being a skeptical person, I asked for clarification in this message:
- zach-hhzhtjqc9 So I should be looking for that new posting on August 9th, accompanied by an email with it's name correct? I assume you'll wait for a little bit before selling to anyone else; and that the price will be the same as well. If you don't mind my asking, why is it that we need to cancel the order now, and re-open it on August 9 exactly? eBay will cancel the order between now and September 9 but not between August 9, and September 9th?
Very clear I feel. sergeantkillerx then responded with this:
- sergeantkillerx Yes and ill also send you a link and because policy states that you can sell a pre order exactly 1 month before its shipping date. I had to cancel all my orders so i dont get suspended.
The first word of his response being "Yes". Which I took to mean: Yes I will post it again on August 9th, accompanied by an email with it's name, and I will wait for a little bit before selling to anyone else, AND the price WILL be the same. And so our personal agreement was done. And I waited, very eagerly, for August 9th to roll around. August 9th comes and at 1:39 pm I send him this message:
- sergeantkillerx Hello, Just wanted to check in and make sure I haven't missed your re-listing of the Ghost Edition; I assume you're still holding it?
I got no response for three days. I then send another message today, August 12:
- zach-hhzhtjqc9 Hello, sorry if I'm bothering you but it's three days pass when you told me you would re-post the Ghost Edition and send me a link via E-mail. If you're busy or just waiting to post it that's fine. But I need to know that you still intend to repost it. Otherwise I have to assume you won't be able to, and I'll have to buy it from someone else; but I would like to buy it from you since we made plans to do so. So if you could message or E-mail me to let me know if you still intend to post it, or that you can't... please do.
And THEN this message came in...
- sergeantkillerx Sorry I can't repost it I had Someone offer me 400 for it
Followed by:
- sergeantkillerx If you can do 375 plus shipping I can give to you instead
THE RAGE! I was hugely annoyed and irritated by this. I quickly looked for another Ghost Edition listing, found one and bought it, waiting to see if that hits the fan as we speak. As explained above, we had agreed that he would repost it for me and for the same price. Then three days after the agreed repost date, sergeantkillerx tells me he's selling to someone else. I don't even think he was going to tell me about that if I hadn't asked. So I'm annoyed, and I respond finally with this:
- zach-hhzhtjqc9 That's fine, I managed to get another one. However, I will have to leave a negative review for this. As we had discussed a month prior to this: Me: "So I should be looking for that new posting on August 9th, accompanied by an email with it's name correct? I assume you'll wait for a little bit before selling to anyone else; and that the price will be the same as well." To which you responded: "Yes and ill also send you a link and because policy states that you can sell a pre order exactly 1 month before its shipping date. I had to cancel all my orders so i dont get suspended." Your first word of that response being: "Yes" As in: Yes I will post it again on August 9th, accompanied by an email with it's name, and I will wait for a little bit before selling to anyone else, AND the price WILL be the same. And then you respond to me with: "Sorry I can't repost it I had Someone offer me 400 for it" and "If you can do 375 plus shipping I can give to you instead" So you deliberately broke our agreement, and then asked for more money on top of that. So I will be leaving a very negative, but fair, feedback. And additionally, I will be posting several of our messages, and my side of the story to Bungie.net for the community there to review and make their own decisions on. I will provide you a link after I have created that thread, so that you can argue against it if you wish.
His response to this was:
- sergeantkillerx Hahaha all you did was make me laugh and sorry this is business more money then more money lol and personally idc Cus I sold all of them anyways lol. And that's pretty sad you went through all that for me but hey ur a noobie you will learn.
August 16th EDIT: I'm almost at the post character limit so I will be brief. I sent the seller a link to this thread for a second time. He said I had left out some newer messages. I asked him what they were. I got no response for three days. Then today I get this:
- somfag (Literally his eBay name is "somfag". And sergeantkillerx no loner exists on eBay.) Hi, I am sorry for my last message that was totally not business like. I also want to apologize for selling the item to a different eBayer although he did offer me more money. Just so you know he messaged me later saying he would give me $400 plus shipping. I also did sell it to him on August 9th. but I am glad you found another one and hope you enjoy Destiny when it comes out. Also I will be leaving positive feedback if not already because you are a good buyer either way I look at it. So I am sorry for all this and Hope this doesn't happen to you again. Thanks and Sorry, xxxxxxxx
I've almost hit the 10,000 character limit for a post so I don't know how I will post more information. But for now... what the -blam- is this about? A complete 180 in personality, writing style, and grammar? I sent him a message of thanks but voiced that I doubt his sincerity due to that name "somfag" and the 180 of personality. If anyone knows a way that I can add more info to this thread without deleting some stuff, making a new thread, or posting stuff to be buried in the response section... please let me know. It wouldn't be fair to sergeantkillerx/somfag to stop posting our messages if he really is apologising; or at least being more respectful...

      • I sell on eBay, I can tell you that he handled the situation horribly. I believe that communication update should start from the seller. It seems, my opinion, that he was hesitant to sell you the item at the original price of $300. He probably saw them selling for more or felt they would. I don't believe he intended to keep that price and wanted a higher price. He deserves the bad review. Things happen, I tried selling a Ghost edition on eBay, but mine got cancelled from the store, so I had to refund and inform the buyer. Communication and trust between buyer and seller is key, doesn't seem like this guy understands that. FYI if you are interested, I usually just sell retro games (NES,SNES,SEGA), don't have anything up now but will for the holiday season.
lion_rage
• That really sucks. Thanks for the warning, if I ever come across him in future, I will be avoiding his listings. I agree with you though. A verbal agreement should have been honoured whether it is legally binding or not. Fair enough if somebody truly offered him more money, but he should have informed you he was no longer selling it to you out of common decency. The fact that he claims somebody offered $400 and then offered it to you for cheaper only makes me think he is a scammer. There are a lot of people who use that same tactic. Make claims of better offers to drive up the price on somebody else who is truly interested. It's just a con. Next thing you know, somebody has offered $450 so you will have to pay $425 if you want to keep it. Sometimes it is legitimate but most of the time it's not. People need to learn to honour what they say to the exact terms agreed upon by both parties. I would leave him the most negative feedback possible. I can't stand shady selling practices.

            • I'm going to take the guess that you are new to the whole eBay system. As a seller with close to 1,700 positive feedback, lemme leave a few tips I've learned over the years. 1. Never trust any seller with a Feedback rating below 200. They haven't been around nearly long enough to have built enough experience in customer relations. 2. Never trust what the seller tells you, they will always look for the best deal and don't care about stepping over the little guy. If you can, make sure they agree in full to any plans you lay down, ensure that they agree to it, and never take anything they say at face value. 3. Be descriptive and short in your feedback always! As well, check their feedback every time. Sadly eBay has made it harder for everyone to see their entire history so it's difficult to tell, but always look at their feedback. 4. eBay should always, ALWAYS be your very last resort. Check other places first.

                • That guy was an a**. However it is not illegal but it was not the right thing to do considering that you had made an agreement and he was going to give you an opportunity to buy it first at the original price. I wish you the best of luck.

I don't think mentioning the Ebay seller on here was the right choice, you did get your money back so you weren't out of pocket and there are a plethora of other sellers. It just so happens that someone offered more money and got the product, it happens everyday, it's not like you were buying a home or something extravagant. You have found a Ghost Edition for yourself, so you should have been happy and left it at that.

Im sure there is at least a few kids who used their parents cards and when they see the bill or somthing will probably decline it. Im sure some one can find a ghost on amazon the day the billing happens
