First of all, it should go without saying that [i]most[/i] intentional crime is affectively aggressive in some way, thus should constitute a sort of hateful discrimination.
But in the end, why should it matter that somebody has punched you because you're black, a Muslim or gay? The crime is somebody has been punched, and that alone is what should be punished.

But seriously, it's to do with the motivation. Yeah, violent crime is typically aggressive/hateful but the reasoning behind it is also important. If you killed someone purely because they were gay, black or a muslim - Then that points towards someone who is more likely to commit that sort of crime again than someone who walked in on their partner cheating and killed them both. In less serious terms, if you punch someone in the face because they are a different colour/gender/orientation or creed - The same sort of thing still applies, if you hate that group of people so much that you will just start fights/attack them then that's a more serious issue than someone who got slugged in a bar fight. They still get punished for the crime, but with a marginally harsher sentence (Typically).
