Texas man kills a woman over $150, gets away with it

Gilbert had admitted to shooting Lenora Ivie Frago in the neck on Christmas Eve 2009, when she accepted $150 from Gilbert and left his home without having sex with him. Frago, who was paralyzed by the shooting, died several months later. Gilbert's defense argued that the shooting wasn't meant to kill, and that Gilbert's actions were justified, because he believed that sex was included as part of the fee. Texas law allows people "to use deadly force to recover property during a nighttime theft." The 30-year-old hugged his defense attorneys after the "not guilty" verdict was read by the judge. If convicted, he could have faced life in prison. He thanked God, his lawyers, and the jury for being able to "see what wasn't the truth." Woman is paid $150, refuses to have sex. Is shot, eventually dies. Note: Prostitution is illegal in Texas IIRC. Since it is an illegal act, the man was entitled absolutely nothing[i], he shot the woman because she refused to commit an illegal act. [/i]

      • They were found innocent. And that's a pretty, how do i put it, "gossipy" web sight. Its headlines are attention grabbers and MaggieLange seems to enjoy her opinions, and is quick to judge others. There is nothing in her sources that indicate he got away scott free. [/quote] This is over simplified, she was willing (or at least it seemed) to sell her body online though Craigslist. By what I know, he is a murder, but the judge and jury disagree and they know a lot more than I. But I still think this is a gross flaw in the justice system, even if I don't have every last fact.

      • Wait... He shot her in the neck. How is that without lethal intent? I mean, had he shot her in the leg, or even stomach... Just in the lower center of mass. But the neck? Pretty much ANY shot aimed at the upper trunk, neck or head is with lethal intent. I'm thinking that there is more here going on.

          • I remember reading about this case and was really puzzled. I too, thought that the defense was framing their case in a very odd manner, especially as a defense against a murder charge with other felonies intertwined. More than anything, I think that closing arguments and the judges instructions to the jury (as to the actual law(s) they would be considering as part of their deliberation) would be the only thing that might possibly help my confusion as to the outcome. But, the prosecution and defense each presented their case, their evidence, their testimony and had the ability to counter the other side's. I can't (with just the facts laid out in a news article) confidently state that I have enough information to say that the jury/judge were "wrong". The State has to (as always) prove their case beyond a reasonable doubt and the accused is and remains innocent until and unless a court convicts them to that standard of proof.

            • That's Texas for you. My only problem here is that he used a firearm. That should ALWAYS be considered lethal force. Using lethal force when your life isn't in danger is excessive, and he should have been charged with negligent homicide. But its Texas, and their laws are their laws. Stupid as I find them.

                In most places killing a hooker doesn't even reach the news, let alone the courts. She tried to steal, he shot her non-fatally, she then died nearly a year later. Big whoop. The only thing wrong with what he did was hire a prostitute in the first place.
