Sheriff's deputies in Texas won't file charges against a father who they say beat an acquaintance to death after allegedly catching him -blam!-ly abusing the man's 4-year-old daughter.
During a social gathering on Saturday, the girl went inside the family's home in Shiner while other members of the family were tending to horses outside, CNN reported.
The father caught a 47-year-old man -- with whom he was casually acquainted -- attempting to molest his daughter, Lavaca County Sheriff Micah Harmon told the Victoria Advocate. The father then allegedly punched the man in the head until he died, Harmon reported.
The sheriff's office will defer to a grand jury to decide whether charges will be brought against the father.
So, should charges be brought against the father? It is clear that he used more force than absolutely necessary here. But, it has been argued in courts before that in certain circumstances, excessive force can be justified.

Crime of passion. Shouldn't be charged with murder, but maybe manslaughter.
Posted by: MyNameIsCharlie Provided that they can find the girl really was molested, he should walk. In the situation described, he acted properly.
Since when is killing someone acting properly? Unless you're in war.

I have quite a few nieces and I have a close bond with them. I can only imagine having my own daughter, the bond would be even better. That being said, If I saw someone molesting my baby girl, I would beat them to a bloody pulp.

Nope, he shouldn't be charged with anything.
Posted by: BDfreshman
Posted by: SlenderTheMan He doesn't deserve any charges, he defended his daughter against a child molester.
And then, once she was safe, proceeded to beat the ever-loving-Christ out of someone. He does deserve charges.
There are laws that protect him. He did nothing wrong, and it was not premeditated. It's possible that he died after a few punches. How do you know exactly what happened and what overdid it? You don't. Are you related to that perv? You're going really far to defend some of the scum of society. If that guy survived, his inmates would have done much worse to him.
-
People who molest children shouldn't be allowed to live.
Posted by: Smoke Yes, excessive force. Killing him was unnecessary.
-
I'd do the same. So no.

Murder of the second degree. Seems fairly clear cut really.
Posted by: WhiteDragon361
Posted by: ultratog1028 Define "-blam!- abuse". Are we talking about a wink or "does this rag smell like Chloroform?"
Since the father beat the man to death, I think it would be safe to assume the latter is the case.
So would I, but the post fails to say. If it were the first one, the father should go to jail. If it were the second, he should be able to walk free while twirling a cane.

Who knows what set him off this time.
Posted by: Flee4Me No one here is saying he should not have defended his daughter. Most of the people here are just pointing out that there is a vast difference between defending a person by neutralizing the attacker with force, and beating a man to death when he was in all likelihood no longer a threat.
Posted by: Munitions lll Okay it's not technically "self defense" but;
[The girl's father] acted in defense of his third person.
It's not like we can expect a 4 year old to anything in self defense. She's completely helpless.

Agreed

No. Self-defence or somesuch guff.

Good.
Posted by: A Goodest Troll
Posted by: WhiteDragon361
Posted by: A Goodest Troll And your post was one entirely consisting of your own subjective morality argument.
Hence why I stated it was my opinion. You and everyone else have a right to disagree. I simply wished to express my thoughts.
And the problem is your morality should have no bearing on what takes place in a courtroom or whether or not someone gets charged with a crime. Legality is what matters.
Legality is what matter for if he will be charged, but I see a difference between that and if he should be charged. Once again, legality =/= morality.
