If the goalie throws his stick during a penalty shot, it's an automatic goal. If any player throws any equipment, to interfere with the play, during a break away, it's a penalty shot. If any player throws any equipment during a game in the direction of any player or the puck, it's a penalty. The only time you can throw or move equipment is when it's broken and you throwing or moving it doesn't interfere with the play in any way. So if a players stick breaks they could toss it to the side boards, but not over them, provided it is not towards the play or another player. As a person who's been watching hockey for 15 years and going, I would say that I believe that it's permitted as long as it doesn't hit another player, it isn't seen in professional leagues much because it isn't too efficient there. That's what I think, I may be wrong, but that's just a hunch.

Mike Smith went behind the net thinking the other team was going to dump in the puck. The guy then shot the puck at the net and Mike Smith threw his stick at the puck.

Probably, yes. You might hurt someone doing that, hence it's not allowed.
