You can get fired for coming in hung-over (high), for drinking on the job--with some companies, or for damaging company image by your recreational use outside of work hours.

Regardless of your company's description or any other defining characteristic, you'd have to drug test. The law does not take exceptions. But you bringing up this question would allow me to have the curiosity to ask what Bungie's games would be like if everybody who designed them were high.
