Bungie stealing artwork?

Just saw this on Twitter. Apparently Bungie literally stole an entire piece of artwork for part of their cutscene in this weeks story. Like. 100%. And this wasn’t the first time they stole community creators work without crediting them. https://twitter.com/elementj21/status/1671281580831297536?s=46&t=nrvyQgPOMU3cQ4zGnpROZQ This is disgusting and shady and proper credit is due.

  • When you submit your art you give them full permission to use it without compensation. Im not defending them but it’s literally in the submission form.

    • Bungie has contacted the artist and claims it was done by an external vendor. they are in the process of crediting and compensating him everyone can relax now

      • New info: The one who choose to use this art in the cutscene had made a mistake. He thought the original design was made by Bungie. Now before you say it… I know. I shouldn’t take anything they say as face value. The artist in question for creating the original artwork is now going to be both mentioned and fully compensated by Bungie for use of the artwork. He might get some decent Bungie funding added to his bank account and the publicity of being mentioned in actual art may really open his career.

      • To be completely honest, I don't see how Bungie could be considered as plagiarizing artwork that was based on their own IP to begin with. If anything this is great publicity for the artist without Bungie having to specifically mention them as inspiration for the artwork at all. Bungie isn't stupid, everyone there probably knew this was going to be traced back to that artist. It's a win/win for both parties - except that people on the internet don't know what is and is not legally considered plagiarism.

            • It’s not stealing. It’s LAZINESS! 🤣 Bungie owns the IP and all the art in it. It’s in the ToS. The guy who made the fanart did not create images of his own, he borrowed the already existing art of the game and created an artwork with his idea. But he doesn’t own the images, he copied it from the game which Bungie owns. So literally, the guy who made the fanart doesn’t own the rights to his fanart. He can’t sell it or make profit out of it because only Bungie owns the rights to all original artwork of the game. It’s in the ToS. It’s not stealing if they own all the artwork that is already in the game. The fanart artist just borrowed it from the game and made his own and submitted it back to Bungie. It’s not stealing. It’s [b][u]LAZINESS!!![/u][/b] 🤣 That’s even worse! If I’m a pro, I wouldn’t use a fanart and add it to my own creation. That is an insult to my capabilities and dignity. Once again, it’s not stealing. It’s [b][u]LAZINESS!!![/u][/b] Now that’s worse than stealing, that’s laughable! 🤣

              • Not really stealing at all. When artist posted it on the forums they agreed to the ToS that clearly states bungie can use any and all art posted without needing to give credit OR compensation. Poster should've read ToS before posting. Also it's Bungies IP to begin with.

                        I’m all for fairness, I am a nobody to bungie or the community so it doesn’t matter but, it wasn’t stolen, people need to start reading terms of service…. If we want to talk fairness, the fan art was created by Bungies idea first, hence Destiny 2. I am angered by Bungie but, this instance is not one of them.

                            • This person can sue if they want, only long enough that this person put his or her name on the picture then yeah it can happen. Bungie is becoming more of a shady company that does shady stuff. And believes that it is ok cause the community doesn't matter long enough they are playing and paying for our game who cares.

                            • This just happened on elder scrolls online. They came out, made a statement that they didn't mean to do it and not give credit as well as they were working with the artist to come to a solution. That's the last I heard of it but from my understanding even though they own destiny, you still can't just copy someone's work.

                            • With stuff like this it's almost always going to be an individual employee screwing up or being lazy vs a company deliberately using stolen artwork. A big company isn't going to steal artwork like this because it opens up way to much liability, is way to visible, and the cost savings would be insignificant.

                            • T's&C's when submitting content to Bungie, for example and by no means a complete picture, art for the TWAB, videos, audio compositions. Will require acceptance that it becomes the sole property of Bungie and they can do what they want with it. They can also choose to credit in a use or not so it may look bad but there has been no wrongdoing.
