Many other titles running BattlEye with a "Low Latency" setting to ON either in Nvidia's Control Panel and/or the game settings have reported performance issues. Could be related to the FPS drops/stuttering causing Rutabaga error codes.
Quick Google search will result in tons of threads about it.
Turned them OFF everywhere and will test further.
