Hello. You would need to contact the clan founder and ask for them to change the name if you wish to take it.

So if the founder hasnt been on for 2 years, I'm pretty much out of luck?

If you can't get in contact with them, yes. As Sonic said, Bungie will not remove a clan name just because the clan is inactive.
