Class Action Law Suit for Being locked out of content already paid for?

What are the chances of this being possible? Lot's of players are saying they can no longer access activities that they used to be able to since the DLC. How can they take some of the game we already had access to and remove our access? I want someone who knows legalese to comment on this. And I want Bungie to burn..........

  • The chances of a class action law suit are none. You signed away your rights to a class action suite when you agreed to the EULA. It explicitly states that you waive your rights to a class action law suite. It also explicitly states that you are not purchasing the game, but purchasing a license to access the game. You at no point in time own any content. You do not own the right to have permanent access to the Raid, Nightfall, PvP, or any other part of the game. https://www.activision.com/legal/terms-of-use FYI I am not defending Bungie or Activision for their actions. Its just a simple statement of fact.

      • I hope you realize that the amount of money it would cost you to recoup your 60 dollars is far more than 60 dollars right? But if you are willing to pay a thousand bucks to save 20 than that’s on you.

      • Everyone should sue individually in their home towns small claims court for violation of contract law. It is easy and costs $35 and you can sue for $500+ to whatever your county max is. Bungie will never fight it and automatically lose the case.

        • Because the people not buying the DLC are the people who wanted to quit the game, Bungie is just giving them the push they needed ,and now they are whining about not being able to play a game that they didnt want to play.

          • Most ppl who are complaining are the same players who refuse to buy the DLC or pre-ordered. Those are the same ppl who are up in arms about how bad the game is or are "done" So if they are so dissatisfied or done as they say, why are they still going on and on? If you like the game then get the DLC and continue on. If you don't like the game then have at it but just dont come crying about it. I mean they were "done" after all. Seems pretty straightforward to me.

Oh I don't know, maybe you should ask the people who asked that question THREE YEARS AGO BACK WHEN DESTINY'S VERY FIRST EXPANSION DID THE SAME DAMN THING. Maybe you should ask the people who kept on asking that question when EVERY NEW DESTINY EXPANSION CONTINUED TO DO THE SAME THING. Son, if you see a line of people throwing themselves off a cliff and you willingly get in that line then you've got no right to complain when it's your turn and they expect you to jump. This isn't some new thing. Destiny players no longer have the right to feel "betrayed" by this whenever there's a new expansion. If you don't like the practice then Stop. Buying. Destiny. Money is the only form of communication they'll listen to.

                • I've been calling people morons when they complained about Trials of Osiris when Taken King launched, since they didn't buy Trials access, they bought Elimination. But this is horseshit. On a massive level.

                  So... you don't want to spend 20 bucks on a DLC but you want to spend way more money in a lawsuit? You have a problem with math. Also they didn't remove anything from the game you originally payed.

                  • The Courts have been crapping all over class action lawsuits for the past 10-15 years, refusing to certify classes and requiring ridiculous requirements. Further, I seem to recall the EULA requires arbitration rather than litigation to resolve disputes, which you can't beat with a class certification iirc. Further, each class member's damages are probably limited to a refund, unless someone thinks they can get punitive damages, which is unlikely without fraud or gross negligence - and I mean fraud like effing illegal, you-can-find-lies-in-writing-that-people-saw-and-reasonably-believed fraud, not just reply comment salt about "feeling" cheated. How many members of the class are there that bought the game but not the DLC and that want a refund - maybe a couple hundred thousand tops? $200,000 x $60 = $1.2M. That might be big enough for a hack class action attorney to bother dealing with, maybe.

                      • pretty sure you can't get a refund due to changes to the core game- if you read the ULA then you'd know that any changes to "online" activities are subject to change without notice..... basically since it's an online game, if we change it without saying, there's absolutely nothing you can do but come on the forums and bitch and moan...... oh wait, people do that without a reason.... :/

                          • lol The stuff that requires DLC wasn’t advertised with the base game...at all. Instead, they were additions that came [b]after[/b] the original release. Seriously, go take a look at the promo material. It doesn’t even say anything about a Raid or Trials or Prestige in the description. Furthermore, [b]always[/b] read the fine print. They can outright ban your account without necessity for explanation. When you connect to Bungie servers, you’re on their grounds and according to the [i]terms of use[/i], anything can change at anytime without notice.
