Not a bug. For your Xbox 360 you will need to purchase The Taken King for it. You are probable getting year 1 engrams hence why they are 100 light level below your character every time your decrypting them.

On my XBOX One I DO have the Taken King, my 360 does not. But even then, the light cap for players without TTK is 32 or 34. So I should be able to still get BLUE engrams at that level. I currently get Green engrams at level 39 and they are TTK weapons. I've even gotten Legendary lvl 40 TTK armor for both my Titan and my Hunter through engrams.

When I was home during the holidays, I leveled up my guys from 34 to 40. I'm guessing because of the cross-gen data transfer and the fact that I don't have TTK my data is kinda "wacked" out. Hopefully the reason is as you said, I need to purchase TTK.
