The original game (and season pass) had an offer at launch where if you purchased it on the 360 you would get a free copy for the Xbox One (or free PS4 version if you had the PS3 Version) if you upgraded your console within the first few months of release.
Currently if you upgrade from XB-360 to XB-1 (or PS3 to PS4) you would need to buy a new copy of Destiny/Db/HoW/TTK for the XB-1. This is the same as for any other XB-1 version of XB-360 games.
