Tau and Marathon symbol look a little too similar for my taste.
Judge for youself...

Marathon was created before the Tau came out for Fire Warrior (which is a great game) and the Warhammer 40,000 (If you want count Dawn of War that's fine).

The art for the tau is quite a bit older than Fire Warrior, which was a craptastic game. /tangent.

There are many many emblems and logos that look like the Marathon symbol. Marathon certainly didn't come before every look-alike, so it's pointless to point fingers at entities that use similar designs.
