Recently today, I encountered a guy trash talking heavily and using racial slurs against me. I told him he would be reported...but he didnt stop. he kept calling me stuff like a n-----, and other offensive words. Just for the account of it....im not black. He kept trash talking me about how my gamertag was so stupid and blablabla...he quit the game when I killed him 6 times in a row. I have already PMed his GT to Shishka...but I'm just wondering...can he get a ban for this?

This would be approaching a sticky legal situation which I am not sure has been decided. Since XBOX live and halo 3 work by setting up one xbox console as the "host" it would be important to know if the "host" was in USA, Canada or even another country. Once that was established, one would need to learn the laws of that individual country. Beyond that it becomes a more complicated legal issue that I am not equipped to discuss. Muting the offending party is still the quick and easy solution :)

Just to put it out there the Constitution only applies to the GOVERNMENT. Once a person enters a private establishment be it a McDonalds or Xbox Live they must conform to the rules set by the owners. Unless the owners of the property or equipment being used is the US government the Constitution has no bearing what so ever. To put it bluntly "In my house you play under my rules".

Its very unlikely this person will get banned. My understanding of the complaint system is if enough people file a complaint under the same category in a 1-month span then that player gets banned. So if this guy only trash talked you and only you filed a complaint he wont be getting banned. Its also your fault for not muting him. You make it seem like you wanted to hear him say those things to you just so you could report him, I think you should be banned if anything. [Edited on 10.13.2008 12:51 PM PDT]

multiple people have to file cause if lets say u dont like this kid at school and you try to file complaints just cause you dont like him thats exactly y multiple people need to file a complaint microsoft doesnt take your word for it

if the trahs talking gets to heavy, report for unpleasant language, or trash talking, and you can file a complaint.

He will not get an exp ban. He will not get a matchmaking ban. The only type of ban applicable to him would be from xbox live, not anything Bungie does. And no, he won't get banned. I have friends that are 100% avoided and nothing ever happens to them, so don't think that anything will happen. Just ignore it.

Yes, it is technically a bannable offense, but I doubt anybody has ever been banned for it. With good reason, too: Trash talking isn't an easily defined term. Removing that element of "trash talking", whether you define it as swearing, bragging or whatever, removes a lot of what makes Xbox Live... fun. In extreme cases like this, it's best just to ignore the guy. After all, he's only trying to make you mad anyway.

i usually dont care for the most part. i mean its a shooter/competitive game so some trash talking is expected but when i get comments like the one i posted above or ones that are really just uncalled for like racial slurs and things like that its just wrong.

i know i hate these guys too but dont report them, just dont talk to them or block them, but reporting is not necessary, it is his account i think bans are stupid just get out of their way

Xbox Live is in charge of bans for thinsg like that, not Bungie. Yes, he can get temporarily banned for things like profanity and harassment, but multiple people need to file a complaint in order for it to happen.
