Consider that the only information we have is that Marty is suing Bungie over unpaid benefits.
It seems unlikely that an individual would sue a company knowing his allegations are false. The falsities would likely come to light, and he'd lose the case.
It seems more likely, given that Marty has gotten the law involved, that Bungie truly hasn't paid him his due.

I'm not trying to imply anything, I just want to say that there is the possibility that his claims aren't as clear and certain as he thinks.
