Man finds someone molesting his daughter, and kills him...

Should he be charged with anything?
Sheriff's deputies in Texas won't file charges against a father who they say beat an acquaintance to death after allegedly catching him -blam!-ly abusing the man's 4-year-old daughter. During a social gathering on Saturday, the girl went inside the family's home in Shiner while other members of the family were tending to horses outside, CNN reported. The father caught a 47-year-old man -- with whom he was casually acquainted -- attempting to molest his daughter, Lavaca County Sheriff Micah Harmon told the Victoria Advocate. The father then allegedly punched the man in the head until he died, Harmon reported. The sheriff's office will defer to a grand jury to decide whether charges will be brought against the father.
So, should charges be brought against the father? It is clear that he used more force than absolutely necessary here. But, it has been argued in courts before that in certain circumstances, excessive force can be justified.

 •
Posted by: Hayabusawarrior Thats just wrong. That guy deserved to die.
Maybe he did not deserve to die, but the father shouldn't be accused of anything IMO, I would have done the same thing, well just beat him until he had no teeth.

 •
Posted by: SweetTRIX On a personal level, I wouldn't charge him with anything. But from the point of the law, i'd be surprised if he wasn't charged with something. I doubt any judge/jury would convict him though.
He can't be charged, under Texan laws it's self defence. Also, look two posts up, they decided not to indict him.

 • No he shouldn't get charged that molester most likely has scarred that kid for the rest of her life I would have done the same knowing that a sick -blam!- was doing that to my daughter.

 • No he should not be charged. He was defending his family. Besides, he only killed a peadophile.

 • No, I'm saying he may feel as if beating the -blam!- outta that guy was the best idea at the time. The justice system most likely wouldn't put death plenty on the rapist if he was alive, so hey, If You Want Something Done Right... [Edited on 06.13.2012 7:53 AM PDT]

 • I honestly couldn't tell you how I would react to someone doing such an awful thing to my daughter. I couldn't say that I wouldn't kill a man for doing it. Or at least die trying. The only fight I've ever been in was with my daughter's aunt. She shoved a table into my daughter ("on accident") because of rage and... well, I raged back by slamming her head into a wall. It wasn't a good situation to be in and I almost blacked out from how angry I was. I eventually calmed down and walked away but I couldn't imagine something such as what happened in this story. If I took someones life away, I would expect some kind of punishment.
