To do what you propose, Bungie would have to completely separate PVE/PVP.
Bungie has shown absolutely NO willingness to do such a thing. It is apparently beyond Bungie's capability.

They already separate PvP and PvE by scaling everyone to the same level.

PVE "scales" everyone to the same level, including NPCs. Light level does not matter in this game other than gating progress for "higher level" content. PVE/PVP are NOT separated in this game. Truly separating PVE/PVP means having gear that is specific to PVP and that gear can be "balanced" separately from PVE gear. That is NOT the current case in D2.
