Mostly, it's a measure of magnitude. Does your lack of cognitive empathy indirectly hurt others (EG, you feel no qualms about your actions causing harm as long as you get what you want), or does the same lack cause you to enjoy the causing harm.

That would be wrong. Psychopaths and sociopaths are not more defined by "who gets pleasure out of others pain" or "who has better Emotional Intelligence." That is a trope from movies on descriptions of "psychopathic" killers. The DSM-5 starts with defining several traits for Antisocial Personality Disorder such as: >Lying >Disregard for others >Impulsiveness >Irresponsible >(And a key factor) lack of remorse If a psychologist wishes to go further into defining the person, they would look into brain scans and their home life. While psychologists believe Psychopaths are Nature and sociopaths are nurture, it isn't always true. So no, it's simply not a "magnitude of who finds pleasure in who's pain." It's more complicated than that.
