Destiny Taken King Fraud on XBox 360

The Usage Restrictions in the Terms of Sale for the Destiny Taken King expansion in the Xbox 360 Stores [u]explicitly and definitively calls out[/u] the fact that "[b]Access to this item will also be granted to all users on this first console[/b]." See attached JPEG. After over a year of Bungie nickel and dime tactics (I was in the Destiny beta) I actually looked for that language as part of the value of the purchase because I had to choose between the digital download and buying a disc - and I was planning to get an Xbox one when Halo 5 came out, so I wanted to avoid the physical media for TTK. Imagine my amazement (actually, not really too surprised) to find Bungie engaged in what appears to be an illegal bait and switch against an entire group of uses (soon to be called a "class" when the court paperwork is filed, surely) - they are denying this basic element of the terms and conditions and requiring individual downloads by each user. Bungie - I can assure you that my kids are not each going to DL your expansion pack for $40 each - if it comes to that I have told them they have a collective $120 budget to go buy new games from any other Game Studio, my treat. So Bungie, how about an official response? You do not have to tell us when you are fixing it, but every second that goes by without an answer stating that you WILL fix this makes it look more and more like a deliberate act of attempted fraud against a specific class of users that will eventually require legal action. UPDATE 9/17 1900HRS During the course of the day I have been repeatedly sent this link to the Official Statement From Bungie on this: https://www.bungie.net/en/Forum/Post/153801968/0/0/1 In that posting Bungie says: [quote]"As a general rule, players will only be able to access the content that they own the license for. Features like “Gameshare” are not supported by Bungie. This is subject to Platform policy." [/quote] The important part of that: [quote][b]This is subject to Platform policy[/b][/quote] Bungie knows damn well that Platform policy on the XBox 360 is that the games installed on the primary system can be played by all accounts on that box; that is why Microsoft has that policy expressly called out in the Usage Conditions at the point of sale. So [b]**why won't Bungie admit that they need to honor this policy and the clearly stated conditions at time of purchase**[/b]? It is not rational that they would sit silent like this if they didn't have something sneaky up their sleeves. Keep up the pressure guys. Bump the threads, tweet to their staff, copy tech media outlets on your posts. I know Engadget is already asking questions about this issue. The more visibility the more we prevent Bungie from doing the wrong thing. UPDATE 9/20 1800HRS I have my $43 refund from Microsoft (taxes incl.) They said that the TTK DLC is in violation of Platform Policy and they refunded my payment. I'm hoping that Emma's they take it from Bungie's and don't just eat the cost. I got the refund as a credit; I'll be spending it on something OTHER than Bungie OR Activision products. UPDATE 9/21 0800HRS I've been asked "how did you convince them to give you a refund?". The answer is simple: when I was at the Microsoft store in Austin, TX I explained that I was going to challenge the charge on my credit card and that a print out of the Usage Conditions screen capture (see URL in my original post) would be all that was needed to challenge the charge - and they just gave me credit on the spot to avoid the VISA charge-back. If you do challenge the charge, and you succeed, it is not unclear what happens to the TTK DLC content. In the 48hrs since I got my credit it has not disappeared from my console and remains playable by the primary account only (unless you use the dual controller hack).   • We have the same problem but they are only interested in successful logins, raiders and xbox one players. I have repeatedly tried to get their attention... as it IS a problem their end NOT xbox live . Considering at least Xbox support replied when I tweeted them... BUNGIE have yet to do so. I have played since beta... I mean come on... patience is wearing thin here and I am looking at solicitors to put a formal complaint considering it's a breach of THEIR privacy and terms of conditions.
