• It's obvious that OP has no idea what consumer protections are. That quaint little clause does not relieve Bungie, Activision, or any of their affiliates from providing the product that they marketed to us. It does not relieve them of the responsibility to provide a quality product. Nor does it prevent the sharing of or protect them from negative consumer Feedback. I run my own business and have just over twenty employees. We have a website with a similar EULA. My attorney's have advised me on the limits of such clauses in an End User Licensing Agreement, and those clauses do not override the Consumer Protection Laws in the US. If one of my customers could prove in court/mediation that I had abused them, robbed them of product, gouged them for a premium price with a low quality product, etc., I would have to rectify the situation and/or provide restitution, even if it was to the detriment of my business. In summary, your argument doesn't mean shit, OP. EULA's are worth about as much as a used roll of toilet paper. All they really enforce is that you agree to go to mediation with the company before taking them to court. That's it.

      • So if Bungle changed the game to a black screen with a flaming middle finger flying across it you'd be okay with it?

          • They complain about the game to get Bungie to try and fix things. Bungie needs feedback, and that is why these people are complaining. I'm going to start giving the feedback I think they deserve.

              • Complaining about complainers.....the hypocrisy is real. Also even though I don't create any threads here this is the "feedback" section.

That's like saying we make the same such agreement with a car manufacturer when we drive it off the lot. Then we find the actual gas mileage doesn't match the estimate or a couple months down the road our battery dies and we find the alternator craps out on us or the A/C vents weren't properly installed and fly out when the A/C is turned on. Are they not obligated by warranty to fix this issue? Granted, a video game makes no such warranty, but does advertise their product to perform a certain way, just as auto manufacturers tout gas mileage and safety. When their product don't live up to these expectations, they feel it when people go to look for another vehicle. Sure, you can say it's all on us and you'd be right. However, if Bungie took the same approach as you, they could expect the biggest collective middle finger from their fans when they release their next big product. Essentially, you will never win a PR position for any company with your attitude.

              • Vampire Nox pretty much summed this up already. All I will add is that this is a useless argument anyway as this is the feedback section. Agreeing to EULA or ToU, whatever you want to call it, does not mean we have to nor should we just keep quiet with a blank stare and smile on our faces.
