Congress was controlled by the republicans then and they choose not to override Bush's orders , all they needed is 67% or 2/3's vote to overturn a presidential executive order.

Rarely do we see a congress with a 2/3 majority. It happens sometimes but cannot be relied upon at all to stop presidential action. If Trump gets elected Congress will be much closer to 50/50. Not even taking Into consideration that if he starts military action there wouldn't be a chance to stop him.
