You are getting banned if they detect a third party thing on [b]your [/b]system. They changed the terms of use in that way that you also get banned for taking advantage from your hacking partner. And if your fireteam member hacked and you kept taking advantage from that (Playing multiple matches after that) it's your fault by far.

Did you report him? How many matches did you play together? Were they ToO matches?
