No, Id say the tiers are initiated based on current stats. Then, reset them every DLC. That would enable upward mobility, take into account long term stats, and prevent abuse.
It actually doesnt punish anyone. It does reward everyone with true competition.

They arent nearly as rare as you think. Plus, my suggestion is just that. The stats used could be widened, as a previous poster suggested. No one gets punished.

They are absolutely as rare as i think. Each week when we play its normally against the same handful of players, noa week goes by where we dont fly into a game knowing who we are playing against. Some of the people who are really good at ToO who we know them from their GT are... Obie slice... 131 flawless runs but only a 1729 ELO. Apart from these guys theres no real competition with ToO but even still none of them are over 2k. You then have the problem of everyone in the teams having different ELO ratings which id assume you would want them to average out the ELO. But thats what SBMM does already, i think its down at the moment but if you go to control game play lists which youve recently played on destinytracker the average ELO per team is almost identical and it even gives each team a % on who they think will win. People will always be punished no matter what way you go about it but restricting people to their ELO ratings will make the pool of players people will vs even smaller then it already is and wait times to find those teams will also blow out which are exactly what Bungie are looking to avoid.

Elo is a decent stats rating. I used it in my suggestion because its readily recognizable by many. Bungie has a galaxy worth of data they can use to create a, lets call it, "true skill" rating. That would determine the tiers. Now, I know and play regularly with over a dozen players with over or around a 2k elo. They arent that rare. Youre getting hung up on specifics. This is a suggestion, a thought. As a thought develops, it changes and adapts. A wider range of skill in each tier would be fine. But, and this is important, the skill gap cant be too wide or narrow. Too narrow and incentive based competition is lowered. Too wide and there is no real competition and this also lowers the inventive to get better.

Ill never support a system which narrows the field of search in a game type which is only played by a select few to begin with. Guardian.gg tracks around 400k people a day playing PvP yet last week in ToO only 381k people played over the 4 or so days it was open. Now im from Australia and i see the same people each week playing ToO and thats because the win based match making also has a CBMM element to it and it matches me with other players from Australia and NZ. Most games we play now are people we have played against in weeks gone by, if you go and divide up this small handle of players i play against into an even smaller hand full it will turn to complete shit... long wait times in orbit along with going against the same 2 or 3 teams for the whole flawless card. Bungie know that connection is the key when it comes to ToO which is why they havent touched its matchmaking for a long time, they introduced bounties which give nightfall grade rewards for all the people that complained that they never went flawless and never got good gear then they even added in that you get armour and a weapons after 5 and 7 wins. But scrubs will never be happy unless they get handed a trip to the light house. I always say that there 2 types of people who cry about the way ToO match making works. 1. people who just suck and will never get to the lighthouse 2. people who have hardly played ToO or elimination but they just expect to go flawless and expect it to be super easy.
