Well it is simple.
Standard company policy states that all creative suggestions without proper permissions will be declined.
In your case it is a simple copyright infringement since you are making money off of material that is not yours. Without the proper permissions to use the material for a financial gain, even if all proceeds were given to a charity, the company has the right to deny you usage.
The idea of these items are very cool and creative, but next time make sure you have proper permissions before starting.

The unfortunate part is that he tried to get permission, but was met with no response whatsoever. I guess the legal team just had better stuff to do than give a simple yes or no until product actually happened.
