I know consoles have them when making a account. The terms of use you need to accept them have in it, modifying or jailbreaking can result in console ban. So before you go at it, might wanna think of that.

Should be in there terms of use. Shouldnt be to hard to find on bungie.net. Give it a look and if you cant find it there, i will so the 5minutes max of searching for you.

@UberChief90 I'm not nagging, seriously, i'm just asking WHERE exactly Bungie states that they have the right to ban players because they are not using the console as their retailer 'gave' it to them...? I've been a first minute PS3 player, and exactly as I am disgusted by cheaters, I am disgusted by authoritarian, non legitimate actions by gaming companies. I've of course found the terms, still, i'm unable to point to any article giving bungie's actions legitimacy: (1) exploit this Program or any of its parts commercially; (2) use this Program on more than one computer/console at the same time; (3) copy, reproduce, distribute, display or use any part of this Program except as expressly authorized by Bungie herein; (4) copy this Program onto a hard drive or other storage device unless the Program itself makes a copy during installation, or unless you are downloading this Program from an authorized Activision online reseller; (5) use the Program in a network, multi-user arrangement, or remote access arrangement, including any online use except as included in the Program functionality; (6) sell, rent, lease, license, distribute, or otherwise transfer this Program or any copies thereof; (7) reverse engineer, derive source code, modify, decompile, disassemble, or create derivative works of this Program, in whole or in part; (8) hack or modify the Program, or create, develop, modify, distribute, or use any unauthorized software programs to gain advantage in any online or multiplayer game modes; (9) remove, disable, or circumvent any proprietary notices or labels contained on or within the Program; (10) export or re-export this Program in violation of any applicable laws or regulations of the United States government. Could @bungie PLEASE tell me, where exactly to find the legal basis for banning the said accounts?

Generally, this clause allows them to ban: "Bungie may also impose limits on certain features or restrict your access to parts or all of the Program without notice or liability." But modded consoles fall under number 8, about using unauthorized software programs.

Dear Anidien, thank you for your reply - to your point of restricting the access, it is of course a wildcard for them, but still, this should be a logical consequence, if the user has clearly broken the EULA... What brings me to your next point: (8) hack or modify the Program, or create, develop, modify, distribute, or use any unauthorized software programs to gain advantage in any online or multiplayer game modes; Modded consoles DO NOT ('jailbroken', softmodded or hardmodded / or at least should not) fall under point 8, as 'unauthorized software programs' is in clear reference to the last part of the sentence --> TO GAIN ADVANTAGE in any online or multiplayer games modes; which literally means that point 8 merely gives them the possibility to ban 'cheaters' (as it should be in any game) What is very sad to see, is that people that have a jailbroken ps3 are directly presupposed to be cheaters of any kind... Jailbreaking is not an illegal activity and it should not be Bungie or anyone else, who has to tell me that i have to use my console as the manufacturer 'gave it' to me... This would be as if you decide to buy a new car, but from the moment on you want to change the interior, the manufacturer or the seller would sue you, because you're not using the car as they intended you to use it... I find this very sad and would like to repeat my request - i'd love to know WHERE in the EULA, terms or any other piece of contract is clearly stated that modded consoled are not allowed. Is there any direct communication channel to Bungie in order to have an official position / clearing here? They'd rather improve on cheaters recognition instead of locking out people, owners, who decide to use their hardware the way THEY want to.

Edited by Anidien: 12/17/2014 10:45:56 PMThe problem is, modding the console violates your terms of use of the console itself - it is [i]not[/i] the equivalent of changing the interior of your car. You own your car, you own the interior. You do not own the operating system of your console. Modding your console allows you to make changes on your client side which can become undetectable on the game's servers. So it is a bannable offense to Bungie, and they have the right to make that call under the terms of the EULA.

Have you also read the terms of activision? Since they are linked because both made the game? And sorry for giving you te impression that you were nagging.

Nah, no worries, this is just that it sadens me to see that in a 500mio $$$ game, there wasn't enough outsight to try to ban cheating other than locking out people using their gear how they intend to... And still - i can't remember having to accept any terms of activision, nore ingame or anywhere else?...
