Well, the ME says he can't conclusively say they were born alive. Not born alive = no murder.

    If you can't prove they were alive conclusively, you can't charge the guy with murder. I'm not saying this guy is a saint, but you can't throw the entire legal system's requirements for reasonable doubt out the window if there isn't conclusive proof that the babies could live and breathe on their own. Just because a baby -could- survive outside the womb doesn't mean it did or that the abortion was illegal because determining fetal age is difficult. There have been babies born at 21 weeks that have lived with intensive care in a hospital. In some states, you can have abortions up to 24 weeks (Pennsylvania one of them). So are all late-term abortions done at that time in California where that is legal murderers? Law doesn't say so currently.

  • I guess I read it wrong. I thought it said that the babies were delivered alive and then he killed them. If it's just an abortion then why is he being charged? He must've done something wrong.

    The prosecution is trying to say they were extremely late term abortions (30+ weeks). At the very least that would be an illegal abortion but the state is trying to prove murder since they were for all intents and purposes highly, highly likely to survive outside the womb at that age. i.e., basically killing an infant. Abortion is only legal to 24 weeks in PA. The staff in his office were stating that the babies were older than that (but who knows what deals they made based on their testimony). The Medical Examiner apparently can not conclusively say how old the babies were or if they ever breathed outside the womb to validate the prosecution's charges.

  • Different topic altogether. Really in this story she has become an afterthought and there isn't as much information available. The story has become "Awmagawd the baby snipper!" rather than about her or the racketeering charges which probably hold more weight.
