To everyone claiming this a third-party and you can't hold Bungie responsible, that is incorrect.
Bungie is a multimillion dollar corporation and is in charge of their own marketing. There isn't anything out there or being put out there that they are unaware of. They are 100% responsible.

The legal distinction is whether or not the publisher is acting on their own, or as your agent. If they're your agent, you specifically instructed them to do X, and they did X because you told them to. For example, let's consider Joe Bloggs who puts up street signs for the council. If the council tells him to put up a 40mph speed limit sign, then that sign has legal authority not because JB erected it, but because [i]an agent of the council[/i] did. If he goes and puts up a street sign on his own wick, that sign has no legal authority, even though it was put up by the exact same person. If someone advertises your stuff on their own accord, you can't be held to promises they make, because they're not you and they're not your agent. If they advertise your stuff because you told them to, they're your agent, and you can.

I saw an ad for a sports car 12k$. I jump into truck drive to dealership to buy it. The dealer said "great, let me write that up". Comes back with a bill for 60k. I'm like whoa nelly that's supposed to be 12k. He goes nah that isn't what it says we changed it. I said well that's false advertising and that the legal advice I got on destiny forums says I can class action sue you. So he goes back and sells me the car for 12k and gives me 15 k for my truck and a check for 3. Thanks destiny legal scholars!!!
